The current Privacy Policy of personal data (hereinafter - Privacy Policy) applies to all information, which "Erdani Language Translation Agency" (hereinafter - Erdani), located on the domain name erdani.kz, can receive about the User during the use of the website, programs and products of Erdani.

1. DEFINITION OF TERMS

1.1 The following terms are used in this Privacy Policy:

1.1.1 "Erdani Site Administration" (further - Site Administration)" - the authorized employees on site management, acting on behalf of Erdani, which organize and (or) carries out processing of the personal data, and also defines the purposes of processing of personal data, structure of the personal data subject to processing, actions (operations) made with the personal data.

1.1.2. "Personal data" - any information relating to directly or indirectly identified or defined by an individual (personal data subject).

1.1.3. "Processing of personal data" - any action (operation) or set of actions (operations) performed with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), anonymization, blocking, removal, destruction of personal data.

1.1.4 "Confidentiality of personal data" - mandatory for observance by the Operator or other person who obtained access to personal data, the requirement not to allow their dissemination without the consent of the subject of personal data or availability of other legal grounds.

1.1.5 "Erdani Site User (the "User")" - A person who accesses the Site through the Internet and uses the Erdani Site.

1.1.6. "Cookies" - is small data fragment, sent by web-server and stored on user's computer, which web-client or web-browser sends to web-server in HTTP-request each time when user tries to open page of corresponding site.

1.1.7. "IP address" - the unique network address of a node in a computer network based on the IP protocol.

2. USE OF THE WEBSITE BY THE USER

2.1 Use of the Erdani website by the User means consent to this Privacy Policy and the terms of processing of the User's personal data.

2.2 In case of disagreement with the terms of Privacy Policy the User must stop using the Erdani website.

2.3 This Privacy Policy applies only to the Erdani website. Erdani does not control and is not responsible for websites of the third parties on which the User can go through the links available on the Erdani website.

2.4 The website administration does not check reliability of the personal data provided by the User of the Erdani website.

3.           SUBJECT OF CONFIDENTIALITY POLICY

3.1 This Privacy Policy states the obligations of the Administration of Erdani website on nondisclosure and confidentiality protection regime of personal information which the User provides upon the request of the Administration of the website at the registration on the Erdani website or while placing an order for purchase of Service. 

3.2 Personal information, which is allowed to be processed under this Privacy Policy, is provided by the User by filling out the registration form on the Erdani Site, and may include the following information

3.2.1. the last name, first name, patronymic of the User;

3.2.2. contact phone number of User;

E-mail address of the User; 3.2.3;

3.2.4. the User's address; 3.2.5;

3.3 Erdani protects the Data that is automatically transmitted while browsing the Site:

- IP address;

- Cookies information;

- Browser information (or any other program that accesses advertising);

- access time;

- The address of the page where the ad block is located;

- referrer (address of the previous page).

3.3.1 Disabling cookies may make it impossible to access the parts of the Erdani website that require authorization.

3.3.2 Erdani collects statistics about the IP addresses of its visitors. This information is used with the purpose of revealing and the decision of technical problems, for the control of legitimacy of carried out financial payments.

3.4 Any other personal information not specified above (purchase history, used browsers and operating systems, etc.) is subject to safe storage and non-disclosure, except as provided in clauses. 5.2. and 5.3. of this Privacy Policy.

4.           PURPOSES OF COLLECTION OF PERSONAL INFORMATION OF THE USER

4.1 The Administration of the Erdani website may use Personal Data of the User for the purposes of:

4.1.1 Identify the User, registered on the Erdani website, to place an order and (or) to enter into a remote purchase and sale agreement with Erdani.

4.1.2 Providing the User with access to the personalized resources of the Erdani website.

4.1.3 Establishment of feedback with User, including sending of notices, inquiries, concerning use of the Erdani Site, rendering of services, processing of inquiries and applications from the User.

4.1.4 Determining the User's location for security purposes, fraud prevention.

4.1.7 Notifying the User of the Erdani Website about the status of the Order.

4.1.8 Processing and receiving payments, confirming tax or tax benefits, disputing a payment, and determining a User's eligibility for a credit line.

4.1.9 Providing effective customer and technical support to the User when problems arise related to the use of the Erdani Website.

4.1.10. Provide to User, with User's consent, product updates, special offers, price information, newsletters and other information on behalf of Erdani or Erdani's partners.

4.1.11. Perform advertising activities with the User's consent.

4.1.12. Providing the User with access to the websites or services of the partners of SVAN Translation Agency in order to receive products, updates and services. 5.

5.           METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION

5.1 Processing of personal data of the User is carried out without limitation of time, by any lawful means, including in information systems of personal data with or without the use of means of automation.

5.2 The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular courier services, postal organizations, and telecommunication operators, solely for the purpose of fulfilling the User's order placed on the Erdani Site, including Service delivery.

5.3 Personal Data of the User may be disclosed to the authorized governmental authorities of the Republic of Kazakhstan only on the grounds and in the manner prescribed by the laws of the Republic of Kazakhstan.

5.4 In case of loss or disclosure of personal data, the Site Administration shall inform the User about the loss or disclosure of personal data.

5.5 The Administration of the site shall take the necessary organizational and technical measures to protect personal information of the User from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

5.6 The Site Administration together with the User shall take all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal information.

6.           OBLIGATIONS OF THE PARTIES

6.1 The User is obliged to:

6.1.1 Provide information about personal data necessary to use the Erdani Website.

6.1.2 Update, supplement the provided information about personal data in case of change of this information.

6.2 Website Administration is obliged to:

6.2.1 Use the received information exclusively for the purposes specified in clause 4 of this Privacy Policy.

6.2.2 Keep confidential information secret, not disclose it without prior written permission of User, as well as not to sell, exchange, publish or disclose in any other possible ways the personal data of User, except for items 5.2 and 5.3 of this Policy. 5.2. and 5.3. of this Privacy Policy.

6.2.3 Take precautionary measures to protect the confidentiality of the User's personal data, according to the procedure generally used for the protection of such information in the existing business turnover.

6.2.4 To block Personal Data, which pertains to the respective User, from the moment of application or request of the User, or his/her legal representative, or authorized body for the protection of the rights of subjects of personal data for the period of inspection, in case of identifying unreliable Personal Data or unlawful actions.

7.           LIABILITY OF THE PARTIES

7.1 The Administration of the Site which has not fulfilled its obligations shall be liable for any losses the User suffers in connection with the unauthorized use of personal data in accordance with the laws of the Republic of Kazakhstan, except for the cases stipulated by the clauses 5.2, 5.3. and 7.2. of this Privacy Policy.

7.2 In the event of loss or disclosure of Confidential Information, the Site Administration shall not be liable if this confidential information

7.2.1. Became public domain before its loss or disclosure.

7.2.2. was received from a third party prior to its receipt by the Administration.

7.2.3. has been disclosed with the consent of the User.

8.           DISPUTE RESOLUTION

8.1 Before going to court to resolve disputes arising from the relationship between the Site User and the Administration of the Erdani Site, it is mandatory to submit a claim (written offer to voluntarily resolve a dispute).

8.2 The recipient of the claim within 30 calendar days from the date of receipt of the claim shall notify the claimant in writing of the outcome of the claim.

8.3 If no agreement is reached, the dispute will be transferred to the judicial authority in accordance with the applicable laws of the Republic of Kazakhstan.

8.4 The current legislation of the Republic of Kazakhstan shall be applied to this Privacy Policy and the relationship between the User and the Administration of the website.

9.           ADDITIONAL TERMS

9.1. The Administration of this site has the right to make changes to this Privacy Policy without the consent of the User.

9.2 The new Privacy Policy comes into force from the moment of its placement on the Erdani Site, if other is not stipulated by the new version of Privacy Policy.
